Eliminating the so-called circuit law doctrine — as a Fifth Circuit judge recently proposed, echoing Justice Neil Gorsuch's agreement in the Loper Bright case — would undermine public confidence in the independence of the judiciary and create costly uncertainty for litigants, said Lawrence Bluestone of Genova Burns.
